Notice of Pre-Proposal

Telecommunication Wiring Exemption

Take notice that the State Board of Electrical Contractors (Board) is soliciting comments regarding an amendment to N.J.A.C. 13:31-4.1, governing the telecommunication wiring exemption.

N.J.A.C. 13:31-4.1 requires an applicant for an exemption to submit a certification by an individual (qualifying employee) who certifies familiarity and compliance with:

1. Part 68 of the Federal Communications Commission (FCC) regulations concerning installation of telecommunication wiring and any other applicable Federal regulations; and

2. Applicable National Electrical Code (NEC) requirements.

After the exemption is granted, there is no recertification requirement for the qualifying employee.

The Board believes that the telecommunication wiring technology is continually changing and notes that the NEC is updated every three years. In addition, the Board notes that there may be periodic changes to the Federal regulations. The Board, therefore, is considering requiring a qualifying employee to recertify familiarity with the FCC regulations and NEC requirements, every three years and invites comments.

N.J.A.C. 13:31-4.1 provides that the qualifying employee is responsible for obtaining any required local permits and inspections for all work. The Board also invites comment on whether anyone in addition to the qualifying employee should be able to obtain local permits.
